Crack Sentencing Fair Sentencing Act Retroactivity 2010 – RI and MA criminal lawyer explains the import of the Fair Sentencing Act of 2010, signed into law by Pres. Obama. The law changes crack cocaine sentencing and reduces the difference in sentencing between crack and powder cocaine offenders. The video also discusses whether the law applies retroactively to defendants whose cases are on appeal and have already been sentenced, or to those who have already pled guilty but have yet to be sentenced. NB: The video is general information and one example of a 18:1 ration for instance is not meant to be a real scenario. The example is used so that people can understand the concept of the crack/ powder ratio, but does not play out in reality that way.
