My boyfriend has a 4year old. He hadn’t seen him in 2 years due to the fact of he doesn’t have a car… his child’s mother lost costody due to drugs and her parents were granted emergency costody. He has paid child support every month and has had the same job for nearly 5 years. We live in a one bedroom apartment at the moment, but will be moving just as soon as we know he’s for sure coning home with us.
The costody trial is set for the 22nd, what s the chance of us leaving with him?

It depends on a number of factors however, I would expect the judge to order and social services evaluation of the potential home situation at your place before any placement is made and the child to remain with the maternal grandparents for the time being. Your long term prospects depend on how she is handling her drug issues.

No car so he can’t visit his child for 2 whole years? The courts will not look in that favourably.
Even if you’re talking cross country (then there are planes and trains, buses, etc.) there’s NO REASON a father genuinely interested in his child couldn’t find SOME WAY to see them, and to stay in touch by other methods too – telephone, skype, internet, etc. Just paying support alone doesn’t make him a good dad, or qualify his to raise this child.
I doubt that he will get custody on the 22nd. To this 4 year old his is a stranger. To have even a ghost of a chance for custody he had better make a real effort to get to know this child – with REGULAR visitation – or I hope that the courts leave this child with the only people who HAVE been a constant in his life. But he can WORK towards gaining custody, if he is willing to put in the time and effort.
He might want to check out the Yahoo Group “Dad’s House” for some help with those things that might contribute towards getting his son to live with him – eventually.
